How to use the application

Creating an account

To use our application, you must create an account by providing accurate, complete and up-to-date information. You are responsible for maintaining the confidentiality of your login information and for not sharing it with third parties. You are entirely responsible for all activities that occur under your account.

User behaviour

By using our application, you agree to abide by the following rules :

a) You agree to use our application only for friendly purposes and not to seek romantic or sexual relationships.

b) You agree to respect other users and not to harass, defame, threaten or harm their person or reputation in any way.

c) You agree not to publish offensive, obscene, pornographic, discriminatory or illegal content.

d) You agree not to impersonate another person or provide false information on your profile.

e) You agree not to violate the intellectual property rights of others, including copyrights, trademarks or patents.

The Publisher reserves the right to request proof of age.

By using the application, the user is responsible for all of her activity.

The user guarantees :

• She is a human being, not a computer service or automated “robot”.
• To have the capacity to enter into a binding contract with the Publisher
• To be at least 18 years of age
• Use the application only for lawful purposes as defined below
• Not to have been convicted of a sexual offence
• Comply with these TOU and all applicable local, regional, national or international laws, rules and regulations.

The use of the application by a user under 16 years of age, from the account of a user over 16 years of age, will be under the full responsibility of the latter.

Purpose of the application

Access to and use of the application are reserved for strictly personal use, for the purpose defined in the preamble.

The user undertakes not to use the application and the information or data contained therein for commercial, political or advertising purposes, or for any form of commercial solicitation, including the sending of unsolicited electronic messages.

Registration, login and password

Registration

After downloading the application and when registering, the user must fill in the required fields (display name, e-mail address, date of birth). The user undertakes to provide accurate and truthful information. In the event of modification of the information provided, the user undertakes to modify it in her account.

At the time of registration, the user authorizes the sending of any communication relating to the application by e-mail to the e-mail address provided at the time of registration.

Use – Confidentiality

The user is solely responsible for her password.

The user must inform the Publisher without delay if she becomes aware of any breach of security, in particular in connection with the deliberate disclosure or misappropriation of her login and/or password, so that the Publisher can take all appropriate measures without delay to remedy the breach of security.

In the event of loss or misappropriation of an identifier and/or password, a procedure for allocating new identifiers will be implemented.

Application content

Proprietary rights

Our application and all its contents, including texts, graphics, logos, images, videos, functionalities and source codes, are the exclusive property of our organization. They are protected by copyright and other applicable intellectual property laws.

License of use

By using our application, we grant you a limited, non-exclusive, revocable license to access and use our application solely for personal, non-commercial purposes. You agree not to reproduce, modify, distribute, sell or exploit in any way our application or its contents without our prior written permission.

User-generated content

When you post content on our application, such as messages, comments or photos, you retain ownership rights to that content. However, you grant us a royalty-free license to use and adapt such content in connection with our application and services.

Each user acknowledges that she is responsible for her own use of the GirlsConnect mobile application and for the consequences of such use.

In the event of use of the application contrary to these Terms of Use, GirlsConnect reserves the right to suspend a user’s access to all or part of the GirlsConnect application services at any time and without notice, for any reason whatsoever.

Availability

The Publisher will use its best efforts to provide the User with access to the Application 24 hours a day, 7 days a week, except in cases of force majeure and subject to the following.

The Publisher may, in particular, at any time and without incurring any liability :

• Suspend, interrupt or limit access to all or part of the application.
• Restrict access to the application or certain parts of it to a specific category of users ;
• Delete any information that may disrupt the operation of the application or contravene national or international laws, or the rules of Netiquette ;
• Suspend or limit access to the application in order to carry out updates.

The Editor shall not be held liable in the event of inability to access the application due to an event beyond its control (notably a problem on the user’s server, technical hazards, disruption of the Internet network, etc.).

The user acknowledges that the Publisher’s obligation with regard to the availability of the application is merely an obligation of means.

Confidentiality and protection of personal data – Data collection

We collect, use and protect your information in accordance with the “GirlsConnect Application Privacy Policy” and the provisions of French, European and international law on the protection of individuals with regard to the processing of personal data, as well as the decisions of the Court of Justice of the European Union and the French courts. By using our application, you consent to our collection, use and disclosure of your information in accordance with this policy.

Suspension or cancellation

We reserve the right to suspend or terminate your account and your access to our App at any time and for any reason, if you violate these Terms of Use or if we believe that your behavior is detrimental to our community or our App.

Limitation of responsibility

Your use of our application is at your own risk. We cannot guarantee that our application will be free from errors, viruses or other harmful elements. To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, special, consequential or exemplary damages arising from the use of our application.

The Publisher shall not be held liable in particular in the event of :

• Use by the user of the application contrary to its purpose;
• Damage caused by a user to another user or to a third party in the context of an activity for which the application was used;
• Failure by the user to comply with these General Terms of Use;
• Interruption of the Internet and/or intranet network;
• The occurrence of technical problems and/or cyber-attacks affecting the premises, installations and digital spaces, software and hardware belonging to or placed under the responsibility of the user;

Furthermore, the Publisher is not liable for any damage caused to the User, third parties and/or the User’s equipment as a result of the User’s connection to or use of the Application.

Should the Publisher be the subject of amicable or legal proceedings as a result of the User’s use of the Application, the Publisher shall be entitled to recover from the User all damages, sums, judgments and costs arising from such proceedings.

The equipment used to connect to the application is used by the user under her sole responsibility.

The user must take all appropriate measures to protect her equipment and her own data, in particular against viral attacks via the Internet.

The information, software, products and services included in or available through the GirlsConnect application may include inaccuracies or typographical errors. Changes are periodically added to the information contained in this application. The Publisher may make improvements and/or changes to the GirlsConnect application at any time.

Advice received via the application should not be relied upon for personal, medical, legal or financial decisions.

The Publisher makes no representations about the suitability, reliability, availability, timeliness or accuracy of the information, software, products, services and related graphics contained in the GirlsConnect application for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services and related graphics are provided “as is”, without warranty or condition of any kind, without prejudice to any obligations arising from activities as a subcontractor. The Publisher hereby disclaims all warranties and conditions with regard to such information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, suitability for a particular purpose, title and non-infringement.

Applicable law and jurisdiction
